Have you used Mariano’s pharmacy for prescription medication over the past nine years? If so, you could be entitled to part of a multi-million settlement with Mariano’s parent company Kroger.
The $17 million settlement, filed in an Ohio court, alleges Kroger didn’t consider lower Savings Club prices for prescription drugs, which resulted in customers paying inflated amounts for medications at store pharmacies.
Kroger denies any wrongdoings and says that it correctly reported its retail prices for prescriptions.
According to the settlement website, anyone who paid for prescription drugs at any Kroger store between Dec. 9, 2018 and Aug. 23, 2026 could be eligible for a payout.

How much could you get?
Those who file eligible claims will get a portion of the the $17 million dollar settlement, but payments will vary. According to the settlement administrator, the fund will also be used to pay court fees, and payments to each plaintiff is not expected to exceed $5,000.
According to the settlement administrator, payments will be calculated based on how many people file valid claims, and how much a claimant paid for prescription drugs from Kroger between Dec. 9, 2018 and Aug. 23, 2026.
Customers must have used prescription insurance benefits to pay for the medication in order to qualify for a portion of the payout.
Payments would be distributed within 120 days if the court grants final approval to the settlement, and after any appeals have been resolved.
How to file a claim
Eligible claims will fall into two groups: known claimants and unknown claimants, based on whether Kroger identified someone a potential class action member.
Those who are “known claimants” already received a notice and claim identification number, and claims can be filled out here.
“You will be asked to provide information proving that you are a member of the Settlement Class,” the administrator website said. “You also may be asked to provide supporting documentation or data sufficient to identify your eligible purchases.”
Those who did not receive a notice or claim but think they could be included can also complete a claim form.
“You will be contacted by the Settlement Administrator and asked to provide supporting documentation or data sufficient to identify your eligible purchases,” the website said.
Claim deadline
According to the settlement administrator, the deadline to file a claim is Dec. 21, 2026. More details on the settlement and claim process can be found here.
