BrightPath Daycare in Avon. This brings the total number of lawsuits to at least 11. The daycare closed earlier this year after a former worker was accused of sexually assaulting children.
The civil suit, filed Thursday, is similar in nature to the other ten filings and alleges negligence of the parent company in allowing former BrightPath Avon employee Jan Berrios-Otero to sexually abuse children.
The new suit alleges that Berrios-Otero sexually assaulted a 3-year-old, taking lewd photographs of the child as well as other daycare children, and distributing the photos to others.
Berrios-Otero was arrested in April of this year and is charged criminally with sexual assault in six incidents, all caught on surveillance cameras involving five children. All of them are boys ages 3-5.
The facility was shut down a month later, in May.
