Appeals court declines to reinstate order finding ‘probable cause exists’ to hold Trump officials in criminal contempt

By Devan Cole, CNN (CNN) — A divided federal appeals court sided with the Trump administration on Friday in a case over the president’s use of the Alien Enemies Act in deportation matters — but it did not fully snuff out a lower court judge’s efforts to punish those who ignored previous orders halting the president’s use of the law. The DC Circuit Court of Appeals on Friday declined to reinstate an order from US District Judge James Boasberg that found “probable cause exists” to hold administration officials in criminal contempt for violating his prior orders to temporarily stop using the law to deport alleged Venezuelan gang members. The Friday appeals court ruling is the latest blow to Boasberg’s efforts to hold accountable the administration officials who didn’t follow his orders earlier this year. Nearly three months ago, a three-judge panel of the appeals court wiped away Boasberg’s contempt ruling from April. Now, the entire appeals court has decided to keep that ruling intact. But the court’s decision does not fully tie Boasberg’s hands. Because of the way the appeals court ruled this summer – and the court’s decision on Friday to not disturb that ruling – Boasberg is able to move forward with his fact-finding inquiry around the officials involved in the matter, and several members of the court went out of their way to make that point clear Friday. “The district court remains free to require the government to identify the decision makers who directed the potentially contemptuous actions and to carefully consider next steps,” three appeals court judges wrote in a statement respecting the court’s decision. Lee Gelernt, an American Civil Liberties Union attorney representing the migrants at the center of the case, said the court’s latest ruling “allows us to go back before Judge Boasberg and present all of the new evidence from the whistleblower that the government deliberately violated the court’s order not to hand over the Venezuelan men to El Salvador.” Earlier this year, an ex-Justice Department lawyer alleged in a whistleblower complaint that a then-top DOJ official told his colleagues in March that the administration intended to ignore court orders as part of the government’s aggressive deportation effort. In court proceedings this summer, Boasberg, an appointee of former President Barack Obama, raised the whistleblower’s claims, saying he would be interested in scrutinizing them should any contempt proceedings before him start back up. Three judges at the DC Circuit – all of whom were appointed by Democratic presidents – dissented from the court’s decision on Friday. In a stinging dissent penned by appeals court Judge Florence Pan, the appointee of former President Joe Biden skewered the Trump administration’s “meritless appeal” of Boasberg’s ruling from April and her colleagues’ earlier decision to scramble the judge’s plans. “Our constitutional system was functioning as designed until a panel of this court improvidently intervened,” Pan wrote. “The district court was called upon to check an allegedly unlawful policy implemented by the Executive Branch. When the government apparently defied a court order, the district court properly investigated. In merely seeking information about the government’s apparent contempt of court, the district court did not violate any nondiscretionary duty nor clearly abuse its discretion.” Boasberg, she said, “did nothing wrong.” Notably, Pan also pointed to comments from President Donald Trump earlier this year that were critical of Boasberg as the case was unfolding. Trump called for the judge’s impeachment, prompting a rare rebuke from Chief Justice John Roberts. “We should not leave in place a ruling that says that the district court erred when it did not,” she wrote. “We live in a world in which judges face threats and harassment because of their rulings and have been called ‘rogue’ by government officials who disagree with them. Con promesa de grandes peleas, incluidas un par por el título mundial, este sábado (y madrugada de domingo) llega el UFC 322, que tendrá como plato principal el combate entre el australiano Jack Della Maddalena y el ruso Islam Makhachev por el cinturón del peso welter. Della Maddalena y Makhachev tendrán la misión de hacer un buen espectáculo después de lo que fue el decepcionante final del UFC 321. Aquel combate entre Tom Aspinall y Cyril Gane terminó en un “no-contest” (o sin definición), después de que Gane accidentalmente metiera un dedo en el ojo del campeón defensor, dejándolo incapacitado para seguir combatiendo. El UFC 322 también tendrá la primera defensa del campeón, en este caso, de Della Maddalena, que hace seis meses ganó el cetro de peso welter. El peleador de 29 años es considerado uno de los más completos de la actualidad: tiene físico, ritmo y volumen de golpes para estar sentado en la mesa de los mejores. fizkes // Shutterstock Despite cultural conversations evolving surrounding masculinity, misconceptions remain about men’s sexual health issues. Topics like erectile dysfunction (ED), premature ejaculation (PE), or low testosterone are often stigmatized. This can lead to the circulation of misinformation on important health issues that will impact many men in their lifetime. According to a survey by Hims, 63% of men report having experienced ED, 53% report having experienced PE, and 56% report having experienced low testosterone. More than half of men aged 18 to 65 report having experienced erectile dysfunction (63%), premature ejaculation (53%), or low testosterone (56%). Experiencing these sexual health issues, however, doesn’t necessarily translate to feeling well-versed in them. For example, while more than half of the men surveyed (56%) claim to have experienced symptoms of low testosterone, only 35% report feeling well-educated about the issue. The same goes for ED and PE, where only 40% and 37%, respectively, say they are fully up to speed on these conditions. Widely held misconceptions about men’s sexual health issues muddle the conversation, leaving men misinformed, feeling alone, or worse—feeling like something is wrong with them. Here are three of the top misconceptions about men’s sexual health. Misconception 1: Sexual Health Issues Aren’t Common The first misconception is just how common men’s sexual health struggles are. The thinking goes, if no one’s talking about it, it must just be me. This couldn’t be further from the truth. As already noted, a majority of men in our study admit to having experienced ED (63%), PE (53%), or low testosterone (56%). This doesn’t account for men who may not feel comfortable acknowledging these conditions in a survey, which points to those numbers being even higher in reality. Gen Zs (men under 30) likely feel particularly alone about sexual health issues they experience. Most report believing that sexual health issues don’t start until midlife, and thus aren’t common in younger men. Misconception 2: Sexual Health Issues Always Start in Midlife Nearly half of the men surveyed (47.5%) believe ED starts at or after age 45. However, two-thirds (66%) of millennial men ages 30 to 44 report having experienced ED already. Even more surprising? While only 5%of Gen Z men believe erectile dysfunction starts before age 30, 43% of Gen Z respondents say they’ve already experienced it. So it stands that most younger men who experience issues of sexual dysfunction believe they are statistical anomalies, which isn’t the case. Back to the first misconception, no wonder they feel alone: nearly half of young men are struggling with something that they feel is an anomaly at their age. Likewise, 38% of Gen Z men report having experienced symptoms of low testosterone, yet only 11% believe it’s even possible before 30. This mismatch of perceptions (the belief that something happens to men starting at age 45) versus actual experiences (it’s happening to respondents at age 25) deepens the stigma and keeps men—particularly young men—silent. The reality can also amplify feelings of shame, leaving young men convinced their struggles are a personal failing. As a result, opportunities for early intervention may be missed, with some men waiting years before acknowledging or treating symptoms they could have addressed sooner with a healthcare provider. Misconception 3: Sexual health is just about sexual performance While sexual performance is certainly part of the sexual health equation, issues relating to intercourse alone don’t illustrate the full picture. Notably, sexual health problems can indicate high blood pressure or, in the case of erectile dysfunction, an early sign of cardiovascular disease. Sexual health also impacts mental health. Mental health and sexual health are deeply intertwined, with depression, anxiety, bipolar disorder, and psychosis having possible links to sexual dysfunction. This reality…
